Ceuta: Spain sends troops as 8,000 migrants enter enclave

Spain has deployed troops after record numbers of migrants entered its north African enclave of Ceuta from Morocco.

Some 8,000 people have reached Ceuta in two days, Spanish officials say.

They say the migrants – who include about 1,500 minors – either swam around the border fences that jut out into the sea or walked across at low tide.

Spain’s Prime Minister, Pedro Sánchez has vowed to restore order. Spain says around half of the migrants have been sent back to Morocco.

By Tuesday evening, footage of the beach showed that nearly all migrants had been cleared.

Mr Sánchez travelled to Ceuta and Melilla to deal with the crisis, which exacerbated diplomatic tensions with Morocco.

Morocco withdrew its ambassador for consultations after Spain’s foreign minister told the envoy of her “disgust” at what had happened.

Most of the migrants are said to be from Morocco. The Spanish troops have been deployed to the beach to help border police at Ceuta’s main entry point – Tarajal, on the enclave’s south side.

Dramatic scenes were captured offshore as families waded through the water and officers from Spain’s Guardia Civil went into the sea to rescue young children.

Interior Minister Fernando Grande-Marlaska said 200 troops, plus 200 extra police were going to assist Ceuta’s normal 1,100-strong border force. The enclave has some 80,000 residents.

By evening reports said the number of people trying to enter by sea had decreased. Some migrants were voluntarily returning to Morocco while others could be seen being carried away by soldiers.

Spain’s Ceuta and Melilla enclaves have become magnets for African migrants trying to reach Europe.

Also on Tuesday, Moroccan security forces at Fnideq, the adjacent town to Ceuta, fired tear gas to disperse a large crowd of migrants at the border fence, AFP news agency reported.

Mr Sánchez has received support from senior EU officials, with European Council President Charles Michel tweeting: “Spain’s borders are the European Union’s borders.”

EU Commissioner for Home Affairs Ylva Johansson described the number of arrivals in Ceuta as “unprecedented” and “worrying”, noting that “a big number of them [are] children”.

At the other enclave, Melilla, 86 sub-Saharan Africans entered on Tuesday via its southern jetty.

Melilla has a formidable border fence, and several hundred more migrants were blocked by security forces, Spain’s Efe news agency reports.

Spanish officials quoted by Efe said Moroccan guards had helped the Spanish forces in Melilla.

Spanish media said it was different in Ceuta, where Moroccan border guards stood by and watched as migrants took to the sea to try to reach the enclave.

Most of the migrants were said to be young men, but there were also several families. Many had used inflatable rings and rubber dinghies.

They started arriving in Ceuta in the early hours of Monday. At least one died during the crossing.

Last month, more than 100 migrants arrived at Ceuta’s Tarajal entry point. Most were sent back, except about 30 minors whose ages were confirmed by medical tests.

Since the 17th Century Ceuta and Melilla have been under Spanish rule, though they are long claimed by Morocco. They have semi-autonomous status, like some regions of mainland Spain.

The influx comes amid renewed tension over Western Sahara, a territory occupied by Spain until 1975, when Morocco annexed it. Since then it has been disputed between Morocco and the indigenous Sahrawi people, led by the Polisario Front.

Spain is currently making international headlines after the arrival of some 6,000 migrants who crossed from Morocco to Ceuta by sea, most of whom swam across to Spain’s African enclave.

The figure is unprecedented for one single day, but historically speaking Spain has been the primary port of entry into Europe for north and sub-saharan Africans, with the relatively short boat ride to Spain’s Canary Islands being the preferred route more recently.

In 2020 alone, more than 23,000 migrants arrived on the shores of the Atlantic archipelago, and hundreds more have tragically drowned during the crossing from Mauritania or Morocco to the Spanish islands. 

Can Spain return migrants when they’ve just arrived?

Spain’s borders are by and large maritime, with Spain’s African enclaves of Ceuta and Melilla being exceptions. 

That means that in many cases Spanish authorities can’t immediately return new arrivals to the country they’ve just crossed over from, what’s been dubbed in Spanish devoluciones en caliente (‘fresh’ returns).

So if for example a group of migrants arrives by sea to the Canary Islands in a clandestine boat, both Spain’s Constitutional Court and the European Court of Human Rights state that border officers cannot return them to their port of departure there and then without carrying out any paperwork. 

In Spain’s African enclaves however, Spanish authorities can take the migrants back to Morocco without having to do it through the usual legal channels.

What happens with the migrants when they first arrive?

When immigrants arrive in Spain en situación irregular (in an irregular situation, as Spanish legalese refers to migrants without the right visas or permits), the law establishes that there is a maximum period of 72 hours to carry out the police review of the migrant’s case. 

They’re initially taken to a Temporary Reception Centre for immigrants (CATE), where border officers create a record of the migrant’s details and check if their fingerprints are in any national or international database.

It’s here also where the Red Cross provides first aid and other health assistance to the people who have endured the often perilous crossing. In the current context of the pandemic, migrants are also tested for Covid-19 here through PCR tests.

These centres for temporary migrant accommodation often suffer from overcrowding when there is a large wave of arrivals, leading to other emergency housing options being quickly set up in many cases. 

Depending on the resources available and the number of migrants, these have gone from hotels where tourists usually stay to huge makeshift camps in the forest

The 72-hour limit mentioned earlier is important because that is the limit for them to be held under police custody and can leave unless they’ve committed a documented felony. 

“Sometimes it’s not even necessary for 72 hours to have elapsed for these people, who have not committed any crime, but an administrative offense, to be released,” Gran Canaria magistrate Arcadio Díaz Tejera told Spanish online daily El Diario. 

Any irregular arrival in Spain involves the opening of a case for repatriation from the country that can conclude with the repatriation of that person. The migrants can claim international protection and request asylum at any time .

Only in cases in which these people can be properly identified is it possible to initiate an expulsion proceeding that is neither immediate nor guaranteed. 

The European Union has bilateral agreements that facilitate this with Turkey, Russia and Pakistan but not with any of the African nations most of these migrants are from. 

So Spain cannot forcibly return immigrants by air without the authorisation of the country in question. 

Regarding Ceuta and Melilla, Spanish government sources told Voz Populi that “Spain has to negotiate returns with Moroccan authorities based on a fixed percentage that can’t be surpassed”.

Nigerian president calls on US to relocate Africa Command headquarters

Nigeria on Tuesday urged the United States to move the headquarters of U.S. Africa Command (Africom) from Germany to the African continent to provide more direct responses to ongoing violence and insurgencies throughout the region. 

Nigerian President Muhammadu Buhari said in a virtual meeting with Secretary of State Antony Blinken that given the series of recent clashes with armed rebels, as well as continued efforts to push back on militant Islamist groups like Boko Haram, the U.S. should consider moving its military headquarters overseeing Africa. 

“Considering the growing security challenges in West and Central Africa, Gulf of Guinea, Lake Chad region and the Sahel weighing heavily on Africa underscores the need for the United States to consider relocating Africom headquarters from Stuttgart in Germany to Africa, and near the theater of operations,” Buhari said, according to a transcript of the call released by the State Department. 

“The security challenges in Nigeria remain of great concern to us and impact it more negatively by existing complex negative pressures in the Sahel, Central and West Africa, as well as the Lake Chad Region,” added the president, who is also a retired major general. 

Buhari went on to say, “The support of important and strategic partners like United States cannot be overstated as the consequences of insecurity will affect all nations, hence the imperative for concern, cooperation, and collaboration of all nations to overcome these challenges.” 

Africa’s West Sahel region, which includes Nigeria and other surrounding countries like Chad, Niger and Cameroon, is currently facing a security crisis amid attacks from groups with ties to al Qaeda and the Islamic State. 

While French and United Nations forces have provided assistance to the countries, Buhari argued Tuesday that a more centralized U.S. presence on the continent could offer a significant boost in their coordinated fight against Islamist militants. 

Africom, founded in 2007 as part of the Department of Defense, initially established its headquarters in Germany due to concerns within Africa about a heavy U.S. military presence on the continent, and the upfront costs of moving have also deterred U.S. officials from relocating. 

Last year, former President Trump ordered Africom to move its headquarters from Stuttgart as part of the administration’s military drawdown in Germany. 

When asked whether the plans to move would continue under President Biden’s administration, Pentagon press secretary John Kirby said earlier this month that he would not “relitigate” the decision “when Africom was established about where it was going to be based, and it was decided to base it in Europe.”
